General terms and conditions

1. Preamble

Cerafon is a registered brand name of the Consmart GmbH. The following GTC contain legal information about your rights to the rule of contracts made in distance marketing and in the electronic business correspondence.

2. Area of validity

For every delivery of the Consmart GmbH to consumers (§ 13 BGB) applies the currently in force version of these general terms and conditions (GTC).

A consumer, in accordance with the law, is every natural person that concludes a legal transaction for a purpose, which cannot be included neither with commercial or autonomously occupational actions.

3. Contractual partner

The contract for purchasing the Cerafon starter kit is achieved with the: Consmart GmbH, Rather Str. 110d, 40476 Düsseldorf, CEO: Prof. Dr. Wolfgang Rams, HRB 57261 district court Düsseldorf. Our customer service is available from 9 a.m. to 6 p.m. on weekdays at following telephone number +49 (0) 211 220 656 70 as well as via e-mail at support@cerafon.com.

4. Offer and formation of contract

4.1 The product presentation sets no legally binding offering, but a request on you to fulfil an ordering. Errors are expected.

4.2 By pressing the button “order with liable payment“ you state a binding ordering of listed products on the order site. The contract is achieved by receiving the order confirmation via e-mail immediately after receipt of your order.

4.3 Order of receipt can also be achieved tacitly by delivery of the product. The confirmation of placing an order does not constitute an acceptance of a good.

4.4 The presentation of a product and its description are nonbinding. The description and the picture can differ from the actual product. The provider attempts to keep the descriptions and the depictions always up-to-date.

5. Cancellation right of consumers

You have the right to cancel this contract without any declaration of reasons within 14 days. The cancellation period starts from the day on, on which you or a from you declared third person, who is not the carrier, occupy the goods.

In order to accomplish your cancellation right, you have to contact us, the Consmart GmbH, Rather Str. 110d, 40476 Düsseldorf, available at the telephone number +49 (0) 211 220 656 70 as well as via e-mail at support@cerafon.com, with the aid of a precise declaration (e.g. a posted letter, telefax or e-mail) stating your decision to cancel the contract. For this, you can make use of the attached model cancallation form, which is not mandatory.

For the protection of your cancellation right it is sufficient, that the information about the exercise of the cancellation right is sent out before the expiration of the cancellation period.

Consequences of the revocation

If you cancel this contract, we are obliged to pay you back every payment, that we received from you, including the delivery costs (with the exception of additional costs, that came into being if you demanded a different kind of delivery than our offered, keen standard delivery), immediately and within 14 days from the day on, on which we received the information about the cancellation of the contract. For this repayment we use the same payment method, that you used in the initial transaction, unless we negotiated something else. On no account you are going to be charged any fees.

We can refuse the repayment until we get the goods back again or until you show proof, that you sent the goods back, depending on which the earliest point in time was.

You have to send or give back the goods immediately and in any case within 14 days from the day on you informed us about the cancellation of your contract. The deadline is protected, if you send the goods back before the period ends within the 14 days. You bear the costs for the return of the goods. You have to come up for every kind of deterioration, if the deterioration can be traced back to you after the inspection of state, features and functionality.

6. Prices and delivery costs

6.1 The prices depicted on our sites are end consumers‘ prices.

6.2 Consignments within Germany are post-free. The delivery costs into foreign countries are different and can be obtained from the delivery process.

7. Delivery

7.1 Delivery can be made worldwide.

7.2 The delivery periods correspond to the standard delivery periods of each country.

7.3 Shouldn’t you be able to comply with the general delivery periods due to unexpected demand or deferred delivery with the presupplier, Consmart is going to inform the purchaser. The customer has the right here to rescind from the contract.

8. Payment

8.1 Payment is made optionally per Paypal, credit card or advanced payment. The provider retains not to accept certain kinds of payments in particular cases.

8.2 If there happens to appear a charge back due to an account undercoverage or other unwarranted charge backs, that are represented by the customer, the customer has to pay for every accruing costs.

9. Reservation of ownership

The delivered costs stay in the ownership of the deliverer until full payment is achieved by the purchaser.

10. Allocation of costs agreement

If the customer is the consumer and makes use of his or her cancellation right after subparagraph 4 of these GTC, the customer has to pay for the regular costs of sending back the goods.

11. Further information on ordering procedure

You start the ordering process by non-bindingly putting the button “In to the shopping cart”. You can non-bindingly see the content of the cart every time you wish by clicking the button [shopping cart]. The products can be deleted from the cart in every moment you wish by clicking the button [delete]. If you wish to purchase the products that you have in your chart, push the button “continue with order” or “payment/cash point”. Enter your information there. The obligatory information are marked with a *. A registration is not required. Your data is transferred in code (SSL).

After entering your personal information and your choice of payment method, you reach the ordering site with the help of the button “Continue with order”, where you also can check your entry again. By pushing the button “Liable to pay order” you finish the order process. The procedure can be cancelled at any time by closing the browser window. On the single sites you get further information e.g. on corrective actions.

We point out, that, by purchasing the starter kid, you have the right to make use of the Naka AG mobile phone service (Churerstrasse 35, CH-9470 Buchs SG, Switzerland) together an appropriate registration.

The registration is made through the Cerafon website at www.cerafon.com>”SIM activation”. The activation needs to be established within a period of 6 months, otherwise the right gets obsolete. With the activation of the services provided by Naka AG you agree to approve the Naka AG’s GTC. You find them here (Link).

The Naka AG is responsible for the complete mobile phone services.

12. Text of the contract

You can view the general terms and conditions on this site at any time. If you have a customer account, you can view it at “Shop Login” at any time. Your order details and the GTC are sent to you via e-mail after completion of order.
